Positive UA Court Martial (2.0)

Y'all are gunna hate this but it's just a description of my experience because we all know when we're nervous about our futures, no matter what anyone says, we look to reddit. When this was me couldn't find anything with great description and everyone on this sub is mean to people who make mistakes they consider stupid or unnecessary. Well shit happens.

So it went like this: was informed popped positive for something that wasn't marijuana. did NOT waive my rights and DID NOT MAKE A STATEMENT (if you just want to take the Land go to mast and take your discharge then this is a solid place to stop reading) again DO NOT MAKE A STATEMENT.

Hopefully you're shocked or surprised at the news and show that to whomever gives you this information (thatl help you later). Immediately go speak to the defense services office (dso) at your command or the closest one to you. Now there's a huge distinction between things you can do depending on if your on shore duty or attached to a ship. If you're attached to a ship you cannot waive captains mast but it's still a good idea to talk to lawyers before you speak to anyone else at the command about the situation. If you're on shore duty and your only charge is a single positive UA then the person you're receiving legal advice will show you the option to waive captains mast in lieu of the possibility to go to court martial.

This is a hard decision. after it was explained to me by a professional felt much more confident in my decision. This was the basic run downl got: you can waive captains mast and 9 times out of 10 the captain will just adsep you because it's really hard to prove WRONGFUL AND KNOWING use of a substance beyond a reasonable doubt (which is the burden of proof given to the government in court martial). If you end up going this path you'll still be adsep'd and not have to deal with the punishments the captain wants to give you (probably the full course fuck down 1/2 pay X2, extra duty, restrictions if you command can support and then adsep).

That seemed like an easy choice to me even with the looming small chance of court and with court the possibility of a conviction (that conviction for a single positive UA will be the less than the civilian equivalent of a misdemeanor btw). So I chose to waive my captains mast in the hopes that would just get separated (if you've been in longer than 5 or 6 years you get an adsep board where your lawyer can fight to get you a better discharge characterization). After waiting for about 7 months I was informed that was going to court martial. Once this happens you are officially assigned a lawyer. And things get kinda serious.

You will be arrested by CID or NCIS and be brought in for questioning. This is scary but you do not have to and should not make a statement to these people. Use you 5th amendment right to remain silent. Always let your lawyers do the talking. had to get character witnesses (the higher ranking the better) and get evidence of all the things that happened that night (credit card statements, Uber receipts, witnesses). The reality of going to court set in and was freaking out for a while. But decided to stand on business after went through the court martial results for the past 5 years (monthly reports of results are available to the public here ) you'll see that almost every single sailor that did not plead guilty to a charge (drug or otherwise) was found not guilty (without a reasonable doubt is very hard to get without pictures, videos, text messages, etc. so if ALL they have is a positive UA it's very difficult to convict).

My trial was set for a couple months and my lawyers worked hard in each stage (pretrial, article 39 or discovery, and the actual trial) they got me expert witnesses to help my case and fought tooth and nail for ever piece of evidence and to get certain evidence out (experts, flying people in, and any other expenses are fully covered by the navy). Navy lawyers are good lawyers too and fully work for your case, they're a great resource if you ever need them.

My trial was a single day and was found not guilty. Free to finish out my contract without issue. Now it is important to note that this entire process was EXTREMELY stressful for me because I have anxiety and I've never been in this situation before. You will be sitting around for a long time with the possibility of getting a criminal record and having your benefits that you spent so long in the navy to get taken away. If you truly don't want to deal with that then just take the mast and go about your life. Obviously if you don't wanna go through any of this don't do things against the rules or put yourself in a position to innocently ingest something like did. But if you made it this far it's probably too late for that. This is just my experience and obviously it can go several other ways for anyone else.

This is just to give piece of mind to anyone needing it in this situation. I'm sure there will be plenty of people here being judgemental and that fine. It comes with the territory on the Internet. hope y'all stay up when you'redown and have a good support system that will stand behind you and your decisions, that's what helped me the most through all of this. Like said hope this helps.

Best pilot route?

I am currently enlisted and looking into OCS in a few different branches. In your opinion what is the best quality of life route in the navy aviation community (airframe to choose)? How many hours per week did you typically work as a navy aviator?

Thank you in advance for any information that will help!

FY25 E7 board schedule

Any news on the board schedule yet? I look on mynavyhr and the only thing listed is the precept so far. The last few years LTB has been required by mid June, I know nothing is stopping me from getting ready or submitting a LTB but it seems super late now.

First time LPO, need some advice with underage drinking

So first time LPO here, have a less than three year junior sailor underage that was involved in an incident where alcohol was involved with all parties. A incident occurred where my junior drove to the hospital with alcohol still in the system. Next day comes and I ask him if he was drinking and he said no. Next day command calls him as a witness and repeatedly denies he drank alcohol and wrote and signed an official statement to the command stating he did not drink. Gets called to be a witness at drb the next day and tells the board he did not drink. After he tells his friend who told me that he was drinking and didn’t believe he would get caught if he kept saying no, also believing that the other involved parties would say he was not drinking either.

What should I do in this situation? I know the sailor has good intentions and wants to stay navy, but repeatedly makes bad decisions and involves himself with questionable “friends” all of whom have gotten NJP’d or adsep. I’ve spoken with him before and told him underage drinking was not allowed and if I don’t know about it then I don’t know, but when other sailors get involved like the incident then I can’t keep it at my level.

In my mind he’s really relying on the parties to vouch for him and that could go the other way real quick. I don’t want to be a snitch but I don’t want this sailor to harm his career in the future by keeping those same habits.

I’m medically retiring!

I officially medically retire May 31st! 90% VA I’m excited to transition. Quick question tho. When will I be getting my last pay check. I always get paid from navy fed. Mid month and end month. Will I get a pay check May 30th? How does last pay work? Also selling leave. 50 days in the books. Does that come in with final pay? And last question when does VA start paying?

Departure TLA question

Is departure TLA paid to the date of lease termination, or HHG Bill of Lading? I ask, because I plan on staying at a government hotel the night after the movers come on Wednesday, but am not terminating my lease until the following Tuesday. It was requested to allow around 3 days for the movers to finish their job, so Wednesday through Friday. I wouldn’t have a bed to sleep on if I’m required to wait until my lease terminates….

Any ideas?

DAPA and THC-8 in San Diego

Ran into a difficult situation, I had a Sailor test positive for THC-8. This is known as CBD.

They are on their way to Captain’s Mast for an article 92, since CBD is not an illegal substance according to federal law.

The 2018 Farm bill has legalized CBD.

If the Sailor was “euphoric” at work or a DWI, fine but there is no evidence that this is the case.

How can we justify the validity of this policy for a commercially available substance that doesn’t require a prescription?

-Edit made as to clarify my intent-

CnD for adjustment disorder/anxiety

Officer (SWO) here looking for advice on a pending CnD. My convening authority is pushing for it after my primary mental health provider (via EMH) pushed for LIMDU.

Case is still pending MEB #1 and #2 approval (MEB #1 is my EMH MHP). Been to the ER twice, admitted once (for SI).

ER docs diagnosed me w Generalized Anxiety Disorder (which is a disability). It is still pending approval, I called for an update thinking I was being processed for LIMDU but instead was told it’s CnD from the CA.

No official notification yet, pending MEB #1 decision. This is just a quick way for medical to boot me without an MEB. So, I had a couple questions:

  1. I want to stay in the Navy, but not as a SWO. How do I fight this? (JAG? Talk to my EMH before/if she approves? Talk to CO?) POCR board is also an option.

  2. Is CnD an honorable discharge?

  3. I am Academy, how would I pay back my degree if ADSEP’d?

  4. How do I request a Medboard? Navy gave me anxiety during time at USNA, and became unbearable post commission.

Thank you all for your help

Sailors who had a shore command as their first tour, what were some culture shocks/hard adjustments when you got to a ship?

Many sailors begin their careers straight out of A-School at shore commands and will often be underprepared when they arrive at their next station. For those of you like this, what were some major differences, things you didn't expect or nobody told you about the ship and ship life?

  • Yes, each ship is incredibly different I am highly aware. Rate plays a part in this as well.

SATO won’t allow me to change my flight

So I’m trying to take leave en route to my new command in Japan, tickets just got released and I called to change my flight, they said “no you have to have your previous command request a change” well my previous command just left for deployment. I explained this and they said there’s nothing they can do.

I am talking to my sponsor and they’re checking to see what can be done on their end but I don’t want to burden them too much, has anyone else had issues like this?

Parking in Washington DC

TAD in Dahlgren right now and was thinking about driving up to DC this weekend. Anyone know if it’s kosher to park on the Navy Yard and jump on the metro? Read the 2018 instruction on traffic and parking for the NSAW and it seems to be okay during non-working hours, but would like to hear from someone maybe stationed in the area or has done it. Thanks!

ETA: Thanks to everyone that recommended the Branch Ave station, definitely just going with that! You all are awesome!

I just completed the GAFB / GAFPB and I’m having trouble finding any Navy-related info about it.

Today was the final day for the GAFB (ruck) and I finished with Silver placement. I’ve been looking online for more information (if there’s a ribbon, cert, advancement points that I can put in for) but everything I see online talks about Army regulation. Can anyone shed some light on this or where I could find more info? Do the Army regulations apply to me as well?

CWO application advice?

So I just became board eligible for chief for the first time and some of my chain suggested that I apply for Warrant. Normally, I would be on board with this, but the issue is, I'm a cross rate with only 3 years in the rate and only two of those years LPO on shore at a pretty cake command if I'm being honest. I feel somewhat reluctant because I feel that I haven't really been tested in the rate and don't necessarily feel like a SME but I am very much interested in the program. Being encouraged has me thinking about it, but I'd like to hear what other's have to say about the situation, preferably leadership, CWOs or someone who has sat a board. Currently sitting at 14 years and on my way out to my first sea command in my new rate next month.

Keratoconus special operations

I would greatly appreciate any help or info anyone has on this. I am currently enlisted I was diagnosed with keratoconus during MEPS but was lucky enough to get a waiver at the time I was pursuing the ND rate I was granted an additional waiver when I received my contract for ND that was supposed to let me continue onto the pipeline. However during the special physical I was denied due to me having keratconus. This was almost 3 years ago. As of now I would like to pursue the EOD pipeline but I am not sure if I’ll be able to for the same reason.

My main questions are: Is it possible to get a waiver? I know there’s medical procedures I can get done but will it make me eligible? (IE. CXL, corneal implants, sceptical lenses, corneal rings) Is there any other way around it for now?

I’m just looking for different options. I’ve done a hefty amount of research on keratoconus and read stories of people who went through the pipelines then developed it and received treatment then. This is a big part of why I joined and id like the opportunity to pursue this goal of mine. I know going to medical and discussing this with them is probably my best option and I already have that set up but any additional information or possibilities would very helpful. Thank you in advance!
