Where can I find the best practice essay exams/ what are the best strategies for practicing for these essay exams?
Don’t know if anyone will really see this post but fire away. Feel free to ask anything about citations, BB rules, spacing/formatting, signals (those mystical words like See and when to use them), and when to italicize your periods and commas.
For some reason when my professor described 2-207 as "battle of the forms", I thought it was a silly way to describe it and immediately thought of it as a round of smash.
I got really bored and asked chatgpt to give me a rendition of it and it was literally exactly how I imagined it
Scene: Kirby and Rob are merchants trading tech parts and each wants their own terms to control the deal. The match opens on Battlefield Stage, and the crowd watches closely to see whose terms will win in this Battle of the Forms.
Round 1: Kirby’s Offer with an Arbitration Clause
Kirby initiates the match by sending his offer to Rob, throwing down a powerful Purchase Order that includes a binding arbitration clause. Under this clause, any disputes will be handled in arbitration, rather than in court.
Teaching Moment:
In a typical sale, Kirby’s offer (Purchase Order) would usually set the terms. However, under UCC § 2-207, if Rob’s acceptance adds or changes terms, they might still have a contract—even if the terms differ!
Round 2: Rob’s Response – The 2-Year Warranty
Rob receives Kirby’s offer and fires back his Order Acknowledgment, accepting Kirby’s offer but with additional terms. Rob’s form specifies a two-year warranty, ensuring he’s protected if the parts fail.
Teaching Moment:
This scenario falls under UCC § 2-207(1) and (2). Because both Kirby and Rob are merchants, Rob’s additional terms (the warranty) automatically become part of the contract unless:
Round 3: Kirby’s Disclaimer of Consequential Damages
Kirby notices Rob’s 2-year warranty term and strikes back with a Disclaimer of Consequential Damages in his final invoice. He wants to limit any additional liability if Rob’s business suffers from faulty parts.
Teaching Moment:
This is where the “material alteration” rule under UCC § 2-207(2) comes into play. A disclaimer of consequential damages is often considered a material alteration, meaning it would significantly change the contract's balance. Unless Rob explicitly agrees to Kirby’s disclaimer, it likely won’t apply.
Round 4: Rob’s Final “Express Terms” Power Move
Rob is undeterred by Kirby’s disclaimer. He delivers a finishing move with a written confirmation that his two-year warranty and other terms control the deal. This sends Kirby’s terms flying off the stage!
Teaching Moment:
When terms directly conflict under UCC § 2-207, courts often apply the “knockout rule,” which cancels out conflicting terms. Here, both Kirby’s disclaimer and Rob’s warranty may be “knocked out” if they conflict, leaving only the UCC’s default rules in place for warranties and damages.
Final Outcome (Based on UCC § 2-207 Interpretation):
Thanks to UCC § 2-207, Rob and Kirby have a contract despite differing terms. However, conflicting terms (such as the arbitration clause vs. Rob’s two-year warranty) may cancel each other out. This leaves “gap-fillers”—default rules provided by the UCC—to govern any issues not agreed upon.
Winner: According to the UCC’s “knockout rule,” no one’s additional terms fully win; only terms both parties agreed on remain. This rule is intended to prevent one party from having an unfair advantage when merchants negotiate.

I struggled to cope initially, leading to three arrears in my first semester. However, I managed to clear those by my third semester. While my marks and percentile have improved, the progress hasn’t been significant. I currently lack connections but am gradually building them. Although I don't have external moot court experience, I have participated in all the internal moot courts. I have completed three paper presentations; one is on its way to publication. I am feeling anxious about internships. I have completed three internships: one with an NGO, and another with the Deputy Solicitor General of a circuit bench (this is a person who assists the solicitor general of India in appellate courts or lower) [idk the US equivalent], and I am currently interning with a boutique firm that deals with corporate law and intellectual property rights. I worry that my current experience won’t be impressive enough, and I fear that tier 1 or tier 2 firms might not consider my application due to my past difficulties. They might think I’m not serious or that my application is a prank. I am in a poor mental state and would appreciate guidance from someone.

For the first 25 years of my life I was many things. I was that super-intense socially akward guy with the weird friendship with the popular girl, I was that obnoxious no-it-all who gets caught crying in an empty classroom, I was that really-really-funny guy with no friends whose jokes were always a bit too self-effacing, I was that quiet quy who almost-almost-almost but never quite smiled.
BPD is a fucking bitch. Not as much as bp2, but whatever. I'm a fabulous special butterfly. They're gonna name a law-school classroom after me one day.
Then one day, just for funsies I decided to get an actual therapist. Then one day the popular kids we saw across the bar sometimes invited me to their fourth of july barbeque. All the social anxiety was gone immediately, all the akwardness and discomfort. I was right, I was a normal person deep down. Then I came to law school.
Law school has shredded the stability I worked so hard to build. My episodes are back and I've had to way up my meds to avoid psychosis. I spend my time in bed. But the worst of all is that its made me socially awkward and anxious again.
Earlier today I was super disassociated and agressive and akward in a social group. It split up in less than 2 minutes. I wish more than anything I could make people understand I'm not control of the way I behave. I'm responsible for it, and I want to be held accountable for it, but I'm not in control of it.
Again, for anyone in the back: I take responsibility for the things I say and do. I'm trying to fix it. I'm entirely aware that I'm that "weird guy" in my class. Fine. I hate it, but fine. Being weird doesn't feel natural to me. It feels uncomfortable and external. People say "be yourself" but this doesn't feel like me at all. It feels like I'm trapped in someone elses body.
I am turning this battleship around. I've gone from bottom quarter to bottom half of my class. I finished all my shit early today. I've figured out how to hide my symptoms better. I'm feeling optimistic.
I have a (somewhat) irrational fear of flunking out especially since I got my first F last week. How common is flunking out of law school? I heard they almost never flunk people but I’m still terrified.

People leave their dirty dishes and sometimes soggy food in the sink. People don’t clean up after themselves. People chew, guzzle and slurp disgustingly. In a couple instances, I’ve found massive unflushed shits in the toilet. Like are all law students this socially unaware and gross or is my school especially bad? Hoping it’s not this bad in practice bc I’m at my wit’s end 🤢

I know this sub is a big fan of Freer’s videos on Barbri (as am I) but I just found out he wrote the Civil Procedure version of the Short and Happy Guide series. Has anyone read that? Is it worth the $28 on Amazon?

First semester is almost over and my brain is so fried I can’t figure out how to study. Anybody have any tips on getting back in the game? I feel so overwhelmed with the amount of information I need to know and finals are in three weeks and I’m SO SCARED. Anybody study tips, life tips, anything are appreciated 😭
What did you do differently would you say? What’s the most common mistake people who didn’t get A’s made and what’s the most underrated advice you’d give others ? I’m still trying to wrap my head around the curve . Like it feels like you could do your best and study all day and night but someone else could write a tad bit better than you and you no longer get the A. I’m someone who’s been doing lots of hypos, utilizing office hours, I read all the cases and anything I don’t understand I’ll ask. However one of my professors doesn’t speak about the exam, did not give us a midterm and refuses to go over hypo answers with me. Also how did you guys learn to write answers for the hypo? I feel like the actual taking of a hypo is so much different than simply briefing cases and me and my classmates have been struggling with how to actually write and organize them. For example how much of a rule to put and what to omit, etc etc.
I am a 3L that is wanting to specialize in tax. I am taking FIT this fall and will be taking Corp Tax, Partnership Tax, and Securities Regulation next semester. I am at TTT, a top 60 law school ranked in the top 15%. What are my chances of getting in, I am planning to apply in December after I get my grade back from FIT while also leveraging that I will be taking all three classes next semester. I'm just looking for some advice on how to navigate applying!!

What do you do to actually "study" your outline? Or functionally memorize it?
I am not talking about memorizing like you could literally reproduce it word for word, but just a functional memorization to take with you into exams?
I suspect there is a good bit of just "sitting and grinding" by reading it a billion times, and addressing questions as they come up, but I am curious if there are other techniques people have found effective as well?
