How will the courts act towards felons being charged with this section after the few cases where they have found non violent offenders, who have completed there sentence and parole/ probation are entitled to there 2nd amendment rights being restored?
will they have to bring this up to the judges somehow or will the judge know and use the information and tests on there own?

In order to restore the rights will they have to fill out paper work or is it just to be a known thing? how would a cop know when charging a convicted felon that they are violent or not?

I took two semesters for forensic science and in my criminal justice class I learned a term for something like when a person fails to take the correct measures to ensure a crime wouldn’t be committed against them.

My teacher at the time, the then university police chief, used the example of having to respond to students’ reports of items stolen from their vehicles, a crime that could have been prevented from happening to them had those students locked their doors as would-be thieves commonly go vehicle to vehicle checking for the one’s that are unlocked.

Four years later I can’t for the life of me remember what the term was and can’t find it in any old notes. Any ideas?

Help answer a question I’ve had in my head for awhile. No legal experience/education here.

What is the underlying basis for establishing various penalties for various levels of crime? Why for a certain level of crime is the max years/fine amount what it is? Was there research to determine what is most effective? Is it based on long history? Has it changed much over time? Are there comparative outcome studies between places with differing penalty lengths?

What is the point of sentencing someone to life in prison if there's a possibility that they will be paroled? Why isn't "life" life?

When I was 14 I was sexually abused and raped by my biological father. He was absent in my life until I was 11, and then began abusing me at 14 and took my innocence. He is also HIV+.

My mother discovered the abuse, immediately reported him and he ended up in prison. I was on the phone to him when police arrived at his door, and l've never seen or spoken directly to him since. He plead guilty, and so was given 8 years instead of 12, and served 4 in prison, the rest on licence.

I've struggled with my mental health a lot since a teenager and tried to end my life multiple times. His sentence has now come to an end, and I'm quite frankly, a mess.

The police cannot disclose where he is living. I'm constantly on edge worrying I will see him at random, or he'll move back to my area. I now have young children of my own.

I've tried everything to move on, countless therapies, speaking out publicly to help others, and even tried seeking restorative justice with him. But the not knowing weighs over me heavy. Is anyone able to help me track him down?

I want to make it clear, I have no intention of making contact or having a relationship with this man. I simply want to know his rough whereabouts so that I can avoid that area at all costs and not constantly be in fear!

I’m looking for information on case details regarding a murder in TX. I know the convicted’s name, what he was charged with, inmate #, etc. I just can’t seem to find ANY details further than that when trying to research. Any tips?

i wanted to know the statistics on how often first time murderers commit a second murder before they're caught. i've been watching documentaries about cold cases and they always say "the killer is still out there and could kill again" but it doesn't seem common. i actually had an uncle who was murdered and while his killer was already a know criminal and the cops never arrested him for my uncle's murder, he never killed again. not important to anything academic i was just wondering.

p.s. my uncle's killer was also murdered and im not saying i wish death on anyone but i certainly didn't cry.

Im looking for anyone experienced in the educational pipeline to a Cyber Crimes related field. Im looking to primarily do online courses because my options close by are limited. I dont have any prior experience in LE. Are there any schools you would suggest, either based on affordability or quality of the courses? What degree should I go for first? I have some university under my belt but life got very complicated and I wasn’t able to graduate. My goal is to eventually be able to participate in or help create action plans that help to identify and persecute online predators (child predators in particular). If anyone is currently in this field or has any experience in the process I would appreciate it very much.

I'm writing a mystery story for my 8th-grade science class. I like my stories to be accurate, so I want my detective to operate as accurately as possible (it doesn't have to be perfect, my teacher isn't expecting Shakespeare). In the story, my detective has to interrogate someone associated with the victim, but they don't want to be interrogated. Is there any law that would compel them to be interrogated?

Hi guys! So my court date is tomorrow for driving on a suspended license & I feel as tho I was unlawfully stopped. The officer pulled me over saying my tires were too wide & I either needed to have fender flares or mud flaps on my truck. Any vehicle in Virginia can’t have tires wider than 4 inches without these sort of requisites. (19VAC30-70-180) My tires barely go past 2 and a half inches. The only thing I would be guilty for is for driving on a suspended license, but the officer pulled me over for my tires being too wide & then asked to see my license. Also, this was in the midst of the corona pandemic so I couldn’t really get a restricted license due to courts & the dmv being shut down. I currently now have my license, what are some of my options; if I have any....?

Ever since Lindsey Baum's body was identified there is thing that has really got me confused.. They said she was found in September of 2017 and because the body was not linked to any particular case at the time the body was put off and identified months later in May of 2018. So my question is, if the body of an unidentified child is found is it not investigated right away? And if it is.. doesn't that mean that she wasn't a child when she was found? Anyone have some answers on this or theories?

Over the weekend someone tried to break into my apartment by breaking the door down.

An attempted break in while I'm out isn't all that strange, but the following details have me a bit lost as to why it happened:

My apartment is on the 3rd floor. I wouldn't expect to be a target of a random burglary and have them carry stuff down 3 flights of stairs after. Feels like a bad plan.

There haven't been any break ins in the area. The police officer that came for the report was really surprised by the whole thing. He double checked reports and this is just not expected for where we live. He said it wouldn't be as weird if there was a rash of break ins but there has been nothing.

It was loud. Seeing my door it was obvious this would've been very noisy. Obviously in an apartment complex, people will hear that. One of our neighbors did say she heard it happen and she was terrified, because it was so loud she thought they were breaking her door down. This woke her up obviously, she got her phone to call 911 and looked out her peephole, by the time she got there whoever it was had gone. She said she stared out of it for a while because she was freaked out. But never saw the guy. But this leads into the next point..

It was at night. Everyone in he complex was home, why would you commit a random burglary when people are likely to be inside, and even if not, neighbors will certainly hear?

Everything about this is incredible wreckless, and leads me to believe it wasn't random, they really wanted our apartment for some reason and didn't care about all these road blocks. Does anyone have a logical explanation for this kind of a break in attempt?

This is a strange question, but i still think it is an interesting one:

Lets say you are walking through the woods and you suddelny encounter a prehistoric man, not a Bigfoot, but something like a Neanderthale man wearing pelt clothes and hunting weapons. He looks at you, and you decide to pull your trusty Hiking- Revolver, and shoot him multiple times until he stops living, cause you want evidence for this encounter, to show to your friends, and maybe get him stuffed.

So would that be considered murder in the US, even if it could be determined that that Man was in fact NOT human?

I know you can ask a cop at any time & they'll let you know, but if it turns out you have a warrant you'll be arrested right then. So is there a website I can visit to find out this information or a phone number i can call?

Hi y'all. This place looks pretty dead but I thought maybe having someone to ask questions to or knowing someone is here might liven it up.

I have worked in criminal defense investigations for about a decade. I have mostly worked with public defenders. They have a bad reputation but not only are many of them incredible attorneys, their offices see huge case numbers and so working there almost guarantees exposure to all kinds of cases as long as you can do the work.

I've primarily worked on serious felonies. Murders, rapes, assaults, and all kinds of other cases. I've done death penalty work and helped argue for vastly reduced sentences based on mitigating circumstances. I've worked all over the country.

So. I am not an attorney so you'll get no legal advice from me, and every case is unique, but I am happy to provide insight and opinions as much as I can.

What are some questions a criminal justice professional would want to know about another criminal justice professional? These are officers, researchers, caseworkers, students even, and other services that tie into the system.

Hi everyone, my friend just got in a car accident in Brownsburg, IN. He had a previous battery charge. The cops searched his car and found 2 ounces of marijuana a scale and a bong. His girlfriend had talked to the police (stupid I know) and admitted to him selling. What kind of charges is he looking at? And will they try a plea for exchange for names? Any answers will help. I'm assuming he is going to be placed with 2 felonys

My friend (pretty white girl) and I (brown guy) were caught with possession of marijuana (less than 0.5 grams for a skinny joint) & admitted guilty. We went to court and after our sentencing, the police officer was there and told my friend (pretty white girl) that he would have "gone easier" on her if she wasn't caught with me. I wasn't around them when he said that, but I can't believe he would have given someone else mercy when not me. Is there anything I could do since he admitted that he would have enforced the law differently/maybe would have given her a warning if she wasn't with me (middle eastern guy) even though the case is closed with me admitting guilty? This happened in Arkansas (southern, conservative state) and I'm only pointing that to show what kind of guy caught me. Wish I knew what he said before the case was closed because I feel like it's too late to do anything about it now.
