URGENT UPS LOST LAB KIT

Hello everyone! Unfortunately, about two weeks ago, UPS lost a lab kit I was supposed to receive. UPS was unapologetic about this and did not do anything. My lab kit has yet to be shipped from Science Interactive, whose shipping department is ghosting me. I am enrolled at Rutgers for the upcoming spring semester, and if I fail this course, my enrollment will be rescinded. I discussed this with Rutgers, and they said I was able to withdraw from the chemistry course. However, I will be behind on credits and drop out as a part-time student, which would breach the contract. Can I take legal action against UPS or Science Interactive Labs for negligence?

The lab kit was initially supposed to arrive on October 15th. October 15th came around, and there was no package. I contacted UPS, and they notified me that the package was refused or, in other words, the driver was a lazy POS and was too lazy to deliver the package to the right address when he realized his mistake. I had not left my house that day as I was waiting for the lab kit to start immediately as Hurricane Milton delayed processing and shipping. My Chem professor was understanding at first but is expecting the lab work, and I cannot provide that to him. UPS instructed me to change the delivery to prevent it from returning to Florida, but I could not. My package was delivered back to Florida. Science Interactive told me the main lab kit was coming, and a separate package would be delivered afterward. Unfortunately, that was untrue, and two weeks later, I was left without my lab kit. This is frustrating, especially because UPS never told me about my claim. If I were to have my acceptance rescinded, would I be able to take legal action?

Legalease and divorce question

I have the option of paying for Legalease as a benefit with my company. Has anyone ever used Legalease for divorce? It is listed as a service on their sales material.

Company not providing equity statement after last day

I recently left a company and am having issues getting information on my vested shares.

In the past, I had issues purchasing vested stock shares--taking over a year and the person in finance basically telling me he is too busy to stop his work and to help me.

Before my last day, I told HR I didn't want to get into a situation like that again since I have 90 days to purchase my vested shares. HR said not to worry and 3 days max after my last day for an equity statement.

Now it's over a week since I left and no reply to my email. I don't understand how they can tell me 90 days when I don't have the information to even attempt to purchase them. And every day has a potential financial impact since it's eating into how long I can hold them to benefit from long term gains (seems like they're gearing up to IPO).

I do have my original letters but there was a forced sell at one point and I purchased others, so I have no idea how much a check for it would be.

I know it's only been a week but just thinking ahead, what recourse do I have? (Hopefully without burning any bridges at first)

Advice

Hello, recently a friend of mine has been in hot water with the law. They have been charged with sexual assault of a minor. This friend came forward to me and explained their side of the situation and told me they did not do it and it was a false accusation. A few days ago they were re arrested and had an additional charge of online solicitation regarding the same instance added to their list and are now facing 2 charges of sexual assault of a child and 1 count of online solicitation. If the additional charge was added is it still possible that they are truly innocent? I want to give my friend the benefit of the doubt but it’s seeming more and more like they may have done this heinous act. This is all happening in Texas by the way. Thank you in advance

Property line dispute even after survey

Ilive in NY. My 85 year old neighbor as in the process of selling an adjoining lot to my home to some people from PA when she passed away. These people are completely uneducated and impossible to deal with. Now that she's deceased the property disputes are happening again. It's an old mobile home park with all the homes gone. Driveway down the middle 50ft right of way in center. 25ft of each side gives right of way. These neighbors put posted signs in my yard. I paid for survey and had the whole thing mapped out. Me and my 85 year old neighbor agreed to 7ft of each side of the center for Driveway/ emergency services access. My neighbor put posted signs down the center today. Expects to use my side of the right of way without giving access to his. Says I fenced mine off. and in the survey you can see my split post fence is 7ft from the centerline as agreed. And the first 150ft of Driveway is all on my side. He's angry cuz I told him the driveway needs to move over. I've payed for gravel the past 10 years and this all started because I bought a tractor to maintain the driveway and was "digging up his yard" even though I was simply trying to maintain the driveway that's already predominantly on my side. You have right to maintain easement in ny. I told him today to drive on other side of the posted signs if he don't give me 7ft I'm not giving him 7. Make a new driveway. The surveyor I payed was their original surveyor. I payed the same surveyor to make sure it was fair. And the surveyor told me she can't stand working with them because you show them the map and they still argue. It's not even their permanent residence it's a summer camp for them they have had issues with 3 of the neighbors so far and I'm fed up with these ppl I've reached out to my old neighbors estate but nobody has been answering my messages about dealing with the issue. Can I sue them for maintenance costs? Survey costs? Trespassing and property damage for sticking signs in my yard. I'm just so baffled that peoplecan be this dumb. Before they moved in I had all the deeds for the surrounding properties with the boundaries ready for the surveyor. Did all my research to make sure i was right.and I'm just so over this whole thing.

Locksmith scam in Utah

Last week my wife urgently need access to our usps mail box. It’s the type you see in apartments and town homes. One big communal box and everyone has a special key to their own cubby. My wife is a type 1 diabetic and gets her insulin mailed to her.

Our keep from our complex wasn’t working and our maintenance guy had quit. So our landlord wasn’t sure when they would hire a new one to fix it. She suggested if we need something urgently call a locksmith.

My wife called a locksmith that was advertised as being .25 miles from us at noon on a Monday. He quoted her $50 just to come out and when he got here he told her $200 to open and replace the lock. When he was done. He pulled out a bill that said $700 and urged her to pay with cash. She fought back on the price but he said he wasn’t the person to talk too. She would need to call the office and talk to them. And he wasn’t leaving until she payed. He became upset when she payed with a credit card.

When I got home she told me how much she charged him. And I went and looked at the lock, it was the wrong lock, and was protruding off of the front door such that you could see all the mechanisms from the outside. And someone could easily saw it off. The lock was also not approved by usps and I found out later he was supposed to contact my landlord before he did that, and you have to have a usps person present when you change a lock.

We called the front office to complain about the service and they immediately blocked us after we need to talk to a manager about the issue. I drove by the “office” and noticed it was fake. They were using a hospital as their address. The website is broken. And I found multiple other companies using the same fake address, the same fake phone number, and the same fake website.

I checked the local record to see if such a business was registered with the state of Utah and there was no business found.

We called the credit card company and got our money back. As soon as we did this they started texting and calling saying they would give us a discount or but that if we did not pay they would send us to collections. Every text and call is from a random number and in each case they do not give us the name of the company in it. They will say something like “I am from the administration office of the locksmith that performed your service”.

Looked it up online and this is a very common scam. My local newspaper ran 2 stories about it in the last 5 years.

I did get my lock changed again professionally. But now I'm trying to figure out if I should try to ignore the texts and calls. Are respond back with "We want the name of the company, the name of the owner of the company, and the physical address so our lawyer can get in touch with you. We are not happy with the service that was provided. There was a lot of unacceptable work." I am hesitant to respond at all because this is their game and they know how to play it. But I know there is a lot of scammy collection services out there and I don't want them calling us to.

Should I continue to ignore the calls and text if they do not identify themselves with a company name? It could be anyone. We are still blocked from the posted number. Should I contact a lawyer immediately or wait for any legal action via mail or collections agency?

How do people that were sued feel ?

Hello Redditors, I got defamed in the office by someone that I considered a friend. I am thinking of filing a complaint. I really hope this friend understands what wrong he has done because he does not seem to realise it. I think he's acting all tough but he'll eventually realise when he gets the complaint.

Have you ever done something wrong and got sued for it ? How did it feel and did you grow as a person from that ?

I am very curious, because my goal is not to sue solely because of the prejudice, a bit naive, but it's also to make the world a bit better with lessons

EDIT : to add context, he claimed that I have shared screenshots of a personal conversation, created an instagram account and sent it to his loved ones. When I confronted him by text, he said he saw nothing but his girlfriend said I did. I never shared the conversation at any times at all. The thing is he said the same story to some friends and colleagues.

Planet Fitness Contract

I agreed with planet fitness essentially on a 25 dollar per month fee along with a 50 dollar annual fee. Whatever. I got the annual charge somewhat unexpectedly and I went back to check the contract and it says it will be charged on or around 11-01-202. Not 2024. Is this legally a simple mistake or can I actually get PF in trouble?

Small Claims Judgement

I recently won a small claims settlement in Utah. The defendant has stopped responding to messages and is refusing to pay. The defendant is self employed so a Writ of Garnishment doesn't seem like it will be very effective. I've reached out to lawyers to see what steps to take next and every single one of them made it seem like many small claims judgements go unpaid. Is that true? The court hasn't been very helpful and it seems like there isn't much they can do to enforce the judgement. What should I do next? Thanks

Doxing

So I have information that someone I know is engaged to a pedophile. I read the court documents and forwarded them to this person. They met me with hostility and threats of litigation if it came out and hurt them or their business in any way. They are a licensed counselor who works with teenagers and I'm concerned by this persons lack of care for their partners criminal history who is facing 15 years in prison as we speak. Would this person have grounds to sue me if I came forward to the public with this information and proof of everything that they disregarded the proof about their partner ? I know this seems petty, but the person in question I feel should not be treating anyone underage while simultaneously condoning the behavior of someone who is a pedophile & registered sex offender.

Order of Protection/Custody Conflict

Tennessee

My sister has an order of protection established for herself and my niece against her child's father for abuse and threatening to ki11 them. The longest you can have in TN is one year and it just started in July.

She's getting something in the mail from Juvenile Court via Informed Delivery, but her mail doesn't come until late.

She's afraid that it's the baby daddy trying to get visitation and custody. They were not married, but he is on the birth certificate. He already violated the order of protection 4 times by contacting her, so he's got warrants out for that as well.

With the order of protection in place, wouldn't that void any chances of the court granting him visitation?

Restoration company contract help

So after some major storms this summer the home we just bought needed a new roof.

I called a few companies and this guy came out and said he was ex insurance now contractor and could help.

He made us sign an agreement I am kicking myself for now.

This started in the beginning of August and is now getting resolved but I don’t trust this contractor anymore and want out but he’s threatening us.

Our insurance asked for a shingle to be sent to this company called itel to see if it was still made. Our contractor said he sent it and even came to get a check from us for it which my insurance agent said was shady as they would have paid for it.

3 weeks later no word so I call and he says itel said they couldn’t discern anything about the shingle so he needs to send it to another company. After a few weeks he sends the report to our agent and the agent never heard of this company so this delayed us. Then the contractor admitted to me he never sent it to itel. But the company is legit( I checked) however he lied and delayed the process by this.

Also when he came to take pictures and get shingles from our roof he brought his son and the kid could barely make it over the ladder then proceeded to have a panic attack for almost 2 hours on my roof and almost fell off. I wanted to call the fire department he told me not to.

He will not give us an estimate for the roof. He says it will cost what the claim says and we pay 48% plus deductible.

After all this it’s now November and he has been harassing me and the claim agent calling and texting all day for weeks on end.

When I tried to ask him if he knew any financing for renovations for this and other projects (we moved into the home in may and started a full Reno) he said we could apply from his phone and ask for the money we need but he would get all the money and give us the remaining 12k for our other project if we were quiet about it. But said trust me we won’t keep your money. Which is obvious beyond shady

After all this I tried telling him on the phone today since it’s now November we can’t afford the roof and don’t want to move forward at this time. He threatened me and said you will follow the contract and give me the money when you receive it next week.

Are we screwed here? I feel like a fool for signing an agreement but thought we could use the help at the time but I have zero trust for this individual now.

We are in Illinois if that matters at all.

Any advice appreciated.

Thank you!

I'm looking for some advice

I work with disabled adults. Recently a program was implemented for a behavior for one of my clients. It was implemented October 1st. The paperwork for documentation was not given to us to document until the 21st. The manager is asking us to go back to the first and start initialing the paperwork basically going back and documenting everything but just do the best we can if we can't remember. Just want to know if that's considered falsifying documents. I don't want to do anything with the documentation until I know for sure this isn't falsifying information. So anybody who knows anything about this I would so appreciate your advice.

URGENT: Need advice, hospital trying to force a discharge for my DD child

I am the guardian for my adult DD child - he cognitively functions on the level of about a 5yo. He becomes very physically aggressive on the flip of a dime. No observable triggers majority of the time. He will be fine, then suddenly flipping tables, hitting, biting, throwing heavy objects (once a fire extinguisher). He also will try to get out of moving vehicles and run across busy streets. I am concerned for his safety and others.

He does have a psychiatrist, mental health wise he was diagnosed with OCD and anxiety, however I think he also should he diagnosed with a mood disorder "otherwise unspecified."

I brought him to the ER two days ago for increased/dangerous behaviors, I actually took him immediately after his regular psychiatrist appointment as she told me to do so. He met the criteria for a psychiatric inpatient placement. However, they have not yet found an open bed for a facility that handles that and so now this morning they're saying they will be sending him home this evening with just a PRN for "aggitation."

I'm at a loss. I don't feel it's safe for him to come home right now, they did absolutely nothing. Do they have the right to force a discharge? It's only been two days. We are in Ohio. I don't know what legal rights I have regarding this.

Do I have a $150.000 TCPA claim from all unsolicited election SMS and MMS messages they forced on me?

Like the title said: I received about 100 unsolicited SMS and MMS messages. Many using private protected information (phone number, first and last mane, location) and as such specifically send to me without consent. Penalty for this can be up to $ 1500 per message. So I should be able together with probably most voting Americans to make a claim for $150000 for starters. Anyone interested to go for probably the largest law suit in US history?

Edited/Addited for some context This is why obtaining consent is so important. The penalties for violating the TCPA can be severe. Fines range anywhere from $500 per violation to $1,500 per willful violation (meaning you knew what you were doing was wrong, but did it anyway). Some settlements have reached into the tens of millions of dollars.

Clicked on a bad link in an IG bio. Is this prosecutable?

The IG account said it was 18+ content, but didn’t have any posts, just a “telegram” link in bio (I don’t even know what Telegram is). Clicked the bio link and saw illegal photos, I didn’t recognize what they were for about 15 sec because the thumbnails were small. I exited the tab and reported the account to Instagram. I also reported the URL of the IG account to an org called NCMEC.

Now, I have crippling anxiety, and this has made me become very irrationally scared when I dwell on the terrible things I saw. It’s illegal to see that stuff but I wasn’t looking for it so I’m okay right? The name of the IG account and the bio link didn’t indicate there would be any underage content. I don’t want my whole life ruined over this. Can’t believe this material is just out there on social media, kinda want to delete my Instagram of 12 years over this.

Parental Rights and the SOR

I live in TN and I am required to register as a non-violent sex offender. I have put my life back together and I am now married and we have a toddler we are raising. Now, there always seems to be some confusion on things I can do or places I can go. For example, "Operation Blackout" does not appear to apply to me since I am not on the TDOC caseload. All that to ask:1) is it actually a violation to take my family to events like fall festivals, trunk or Treats, bowling or other events and 2) if it is, is this not a violation of parental rights without due process, especially considering SB 2749?

What action would need to happen?

I'm in the state of Utah and just don't know what rights I have or if I have a case.

If a student posts pictures of my daughters home exploding online, is that a threat of violence and is it a report to police situation or get a lawyer situation?

This is accompanied by bullying by this kid at the school but the exploding house is on a whole other level.

Suing a third party for a work place injury

I’m currently on workers' comp. Long story short, the terrain at my job site is steep and has several potholes. I got injured at work while using a heavy-duty dolly, which is designed for flat ground. When the dolly went into a hole, it jerked forward and crushed my hand.

If the lot is owned by UPS and my employer is a contractor, can I legally pursue action against UPS or the property owner due to the poor condition of the lot?

If I am declared legally dead, but am not dead, can I reclaim what was inherited from me?

I have been watching the show Lost (no spoilers please), and have casually wondered what would happen in real life if these people came back.

A plane goes missing and weeks later, there is no sign of wrecked or survivors. Passengers are declared reasonably dead. Surviving family receives inheritance after a period of time. Then, a couple of years later, a survivor manages to make their way back.

Let's imagine that a relative had gotten the house and was spiteful and didn't want to return the house or even allow the survivor to live there. What legal recourse does the survivor have?

Let's assume that the court accepts that a) post-crash the is no evidence to suggest that the survivor was alive and b) there is no evidence to suggest that the death was faked deliberately.

I do not know what to think…

Hello,

I know you all will have your own thoughts and opinions. But can police see if you were a victim in a case by checking your ID? Tonight I was with my friend and partner (I say that lightly), she got arrested and we walked up the street to check on her after she called, then a few minutes later my partner was arrested because they saw he had warrants, but he refused to show his ID to the police officer after we arrived, and they didn’t bother him anymore about it. They only checked my ID because I was going to be driving her car.

A year ago my partner and I had a really bad moment, and he received a misdemeanor charge because of that, and in the report I am listed as the victim. I can’t think of any other way they could know his identity and that he had a warrant since they didn’t check his ID. Idk if my friend told them his name, but she doesn’t know his last name. Idk. Just confused.

Streaming Sites

Hello!

Clarification: He never downloads anything.

My Friend lives in Virginia USA and he uses online streaming sites. He uses sites like Go movies and online streaming services from other countries that are not paid. He just pays for Malware protection when using these sites. He DOES NOT DOWNLOAD anything because of more viruses. He does not download movies and sell them.

Is using a website to watch movies that can potentially harm my computer viruses; is this legal or illegal?

Advice on how to handle.

I work at a private daycare in FL where I bring my daughter. Today I voiced some concerns about her being moved from the infant room to the One’s room. She has Blepharoptosis (Droopy eye) sever in both eyes, she has surgery scheduled to have it fixed when she’s 14 months old. Due to this vision problem she is not able to crawl or walk, leaving her stationary while with other children. Her infant teachers have also voiced that she’s not ready to be moved out of their room. However the owner has told me that because I have voiced safety concerns for her in the one’s room she’s not allowed to be placed there now. She also said that she has lost her spot in the infant room even though no new babies have been moved in there. “I need to look at it from her perspective of running a business” was what I was told. She sent me home and told the infant teachers that my daughter wasn’t allowed back. Is this something she can just do? I’m not even sure where to begin with trying to figure this out. Thank you 😣

My boss is actively trying to steal my money

I quit my job at subway and the owner tried to say if I couldn't get my key back within 2.5hr he was gonna cut me down to minimum wage and charge me to rekey the store and then after fighting with him about that I was asleep the entire time since my alarm to wake up was the time I was supposed to have the key in, then it turned into have the key in by the time the store closes which I also couldn't do since I literally couldn't make it there in time, so he made me show up the next day before the store even opened to turn in my key that he didn't even need and never before had such urgency with it so I originally planned to just turn it in when my check came in but now he's claiming he's going to mail it but I have a feeling he's going to cut me down to minimum wage and just hold onto it and say it got lost in the mail. PA law says I have to be paid on the next payday that would have come up, what legal action can I take if he decides to steal my money
