False allegations made on order of protection

We have new neighbors that just moved in right down the road, it's a private road. They live all the way at the end so it doesn't matter to them. But we've asked them nicely to slow down but other neighbors aren't so nice. Some kids were doing burn outs in the middle of the night so our redneck neighbors starting shooting (not at them) because of this. Well the next day someone wrote an anonymous post on the county group on Facebook. They were commenting death threats to these people. Fast forward a few days, I get a knock at the door to a cop serving me papers for an order of protection. On the the report it says "(my name) threatened to throw bricks through our windows and take us to our maker(god)" "(My name) follows us and my kids to our house to tell us to slow down" "(My name) is sending us messages and harassing us" "(My name) makes her kids run out to the road to yell at people to slow down" The OOP was dropped but what can I do so this doesn't happen again? All of it was false and they only did it because they had my name and no one else's. (No idea how they got my name either unless they went through the groups members and saw my name and recognized my profile pic from when I asked them to slow down, granted, I asked right infront of my house, not theirs.) but it put me through a lot of stress because one of the boxes they checked was to take away my 2nd amendment right even though I've never bought a gun but eventually I'd like to. Brought my kids into it. And the guys mom (recipient of OOP) posted my name saying "we got you". Multiple false allegations, taking away my rights, tagging me on social media, fear of paying court fees and I'm not financially stable that well. Fear of the order going through and them lying to get me arrested. It put me in a dark place and now I fear they'll lie again or if the neighbors act up again then will they put it on me? Again? What do I do so my name isn't used by them ever again.

Can you fire someone for accidentally bringing a pest into the workplace?

Forgive me, because this is kind of gross, but I was browsing the wasteland that is r/askreddit when I stumbled upon a post where someone was claiming that they believed they inadvertently brought carpet moths into their workplace and feared they were going to be fired? Can someone be legally terminated for inadvertently bringing a pest into the workplace? The OP of the post claims it was accidental and was dealing with a poor living situation at home.

Can my ex come on to my property?

I am currently storing a piece of property that we share. We are in the middle of a legal dispute over the division of assets after the breakup. My Ex just sent me an email saying that they intend to look at something and will be physically in my yard to do it. I have repeatedly told them to pause all efforts until after resolution of the legal portion. Are they able to do this legally?

Any pitfalls in this release form?

I'm sending in a copy of a pilot episode for a screenplay I'm writing and they are asking me to fill out this release form. As far as I can tell it is protective of both sides, but I want to make sure I'm not missing anything or overlooking certain wording that could hurt me down the line. Any advice on this would be greatly appreciated. Thank you so much!

What happens if US police lawfully or unlawfully search your phone or electronics and find classified information?

I recently saw that a federal appeals court ruled that police can forcibly make a suspect unlock their phone

“A federal appeals court ruled that police can compel a suspect to unlock their phone using a thumbprint without violating the Fifth Amendment”

Logically, this could also mean that they could do the same with a laptop if a suspect happened to have one that could be unlocked with Face ID or fingerprint scan. I was curious what would happen if they did this to someone with high level security clearance and, while searching, found classified information beyond their clearance level.

Also, what if that same person has notebooks with research that they’ve personally done with the DoD and is therefore classified and police unlawfully searched through the notebooks.

In either of these cases, who would be in trouble? Would it be the suspect for unintentional disclosing classified information. Or would it be the cops for obtaining classified without the required clearance?

Hitting parked car no damage

So I was leaving a parking lot and some guy was parked very out of his spot. He claimed I hit him, of course I dispute this. I got out and looked at his truck and there was absolutely no damage at all. I even asked where is this so called damage at he yelled at me that it doesn't matter where it's at his reporting it to his insurance. I left. He was also angry I pointed out his parking was out of wack and he shouldn't park a big truck where he did. But since there was no damage and he was parked out of the space, what can be done legally if anything?

TN Visa Employee Quit

One of our employees who we sponsored for a TN Visa for quit with no notice to take a job in the United States that’s paying more. I am really upset and want to have his TN visa revoked do I need to contact the department of state what is the best course of action here?

Last name misspelled on legal documents, what can I do?

Hi,

I am 21F, born in a foreign country. Instead of a birth certificate I have a consular of birth abroad. My last name on this document is spelled differently than on my social security number. Think Smith vs Smitt.

I’ve always gone by the spelling of Smith however when I got hired to work as a college assistant at the college I was attending, I was informed they would be using the last name on my social security, Smitt. So I’ve been filing taxes and working as Jane Smitt. And because of this, my college degree will also reflect Jane Smitt.

My NYS ID has the spelling of Jane Smith. I reached out to the DMV to get this corrected and asked them to please update it according to my social security card but I am wondering if and how I can change the spelling of my name on my consular of birth abroad to match my social. I do not have any other documents except my social security to reflect this name as I was born with the name Smith and only my social security and medical cards, college degree, and taxes show this.

What can I do??

Advice on how to properly evict an immigrant from household

Good afternoon, I’m the boyfriend of one of the tenants who live in an apartment in NY state (Westchester county). My GF’s family has allowed a lady with one male child who is grown and one female child who is still school age who are immigrants to live with them in the household.

One of the main conditions of her coming to America and living with my gf family was to not speak to the landlord as she is not supposed to be living in the household with her two children. They have helped her illegally with a job which was given to her by my gf’s mom so that she can afford to get by.

First thing she has done when she came here was break the main conditions of her living here was speaking to the landlord. She has then became a sore thorn in this household with bringing unnecessary drama into this household and has almost gotten us into trouble with her mouth and talebearing to neighbors.

Unbeknownst to us she came to the US with the main objective of getting married to secure citizenship so she has then garnered a relationship with the landlord and has been hellbent on destroying the household she came into as a favor.

The two children have fought each other in the house which has gotten CPS involved and caseworkers have came to the house. She then has lied and said one of my gf’s family members threatened her daughter.

She told us she wanted to leave and go to a shelter and she needed a letter to enter the shelter. So the family has given her a letter to go into the shelter. She then tells us that we could be prosecuted for human trafficking because we let an illegal immigrant into the household.

She then asked for a 30 day notice and doesn’t want to pay her rent for the 30 days she’s going to be here.

We just want her to leave as this is too much to bear for our household. This isn’t even all of the drama she has caused in the household but a few which could be pertinent to the clause of wanting her to leave.

ten day notice

hi i lost my job back in february and have recently gotten a new one. im slowly catching up on bills but have had a ten day notice two months in a row. i paid before the ten days was up. my question is, how many times am i able to get a ten day notice? im located in colorado. im almost caught up😭 ive attached the most recent contact ive received from my apartment complex. do i have to be out by the 13th? or is that when ill receive another ten day notice?

Car Warranty Claim Question

Hi all,

I recently came into a dilemma in which my third party car warranty provider doesn’t want to approve a certain repair and had questions regarding long term action that I would love some insight on. Sorry if this is not the right place to post in advance.

Essentially I have a third party warranty that is based off exclusionary coverage meaning everything is covered except those listed. I developed a rear differential seal leak about a year ago on my car and the provider denied to fix it because it wasn’t a dripping leak and it was only a minor seepage. Differential seals are not excluded in my warranty coverage and nowhere does it say that only dripping leaks would be covered. But fast forward, I decided not to argue and made sure the dealership flushed and replaced any oil related to the differential and made them monitor it. Flash forward to last week, the leak became apparent again and the third party denied the warranty again stating it was only minor seepage. My service provider and technician both argued with the inspector stating that the leak was bad and it should be covered with everything in writing but the inspector said he needed to see a pool of liquid on the floor at the dealership. Based off that logic, I would have significantly damaged my differential if it was leaking in that bad.

My question is, if eventually the differential seal completely fails while driving and it causes damage to my car, will I be liable or the warranty company? I have receipts and proof that I constantly maintained and checked fluid levels and have written evidence from the dealership that the problem is known yet the warranty company denied it.

I’ll probably just fix the issue out of pocket myself but not before I try to fight back as best as possible. And yes, I learned my lesson that all third party warranties are a scam and I’m not going to make this mistake again.

is it wrong if my mom never informed me i was on ssi?

I am 18, and have been diagnosed with a few mental health disorders including bipolar disorder. I just received a letter in the mail (one addressed to me and the other to my mother for me) stating i’m going to be reviving money that will be directed to my PA’s account. My concern is, I never once was aware my mom was getting money for me and i never have personally seen any of this money she is receiving. I never even knew i was on disability and receiving benefits. She has never paid for anything for me besides rent (even then she usually was late on it and we always struggled with money) & ever since i started working when i was 15, she made me start paying her rent and now i have to pay her about a total of $500 a month to help her including putting wear and tear on my car to help her with my younger siblings. I have been financially responsible for myself since i was 14 years old and have been employed since April 2021 and when i went into the social security office they informed me she had started reviving benefits back in 2018 when i was first hospitalized and diagnosed. I have no idea what she uses the money on because she never has provided for me even as a minor and i am unsure what to do.

I plan on confronting her about this today because does this go on my record? Is this right? I don’t think I even should be accepting benefits because my bipolar disorder doesn’t affect my ability to work and i have held down the same job for 3 years and acquired a managerial position. EDIT: I am kinda just curious if this is normal and if my record is screwed up. i have never been told i was on disability and have always helped provide for my family so im unsure what my mother is doing with the money she’s receiving if she doesn’t pay for/provide me with anything besides shelter- but she kicks me out or threatens to weekly but turns around and begs me and my grandparents for money. I know this money is supposed to be used to provide for me but i dont know why she never informed she out me on disability or told me she got money for me.

ADA and job assurance

Hey everyone. I’m a new grad nurse in an ED in MD. I was a tech prior so i’ve been working for this hospital since last June (11 months). Started as a new grad February 12th.

2 days ago I fell and broke my distal fibula (ankle) at a restaurant. I may need surgery and can put absolutely no weight on it. If I get the surgery it could be 6 weeks of non-weight bearing. I don’t qualify for FMLA since i’ve only been with the organization for 11 months and not a year.

They recommended that I file for short term disability through my benefits along with ADA. I did all of those things yesterday. They filed me for a leave of absence.

My question is, with the ADA is a leave of absence considered a reasonable accommodation? Is my job still guaranteed if my claim is accepted through them? I just really don’t wanna lose my job!

I had 2 weeks of new grad orientation left when this happened. Still on probation technically (until May 12th) since I switched job titles which means they could fire me for any reason I guess?

Medical Provider Still Attempting to Collect Payment from me

Hi, I know I’m new here, so I’ll keep it as quick as I can.

In February of 2023, I slipped at work and tore my anterior and posterior shoulder labrum which required surgery. (Side note: my assistant manager that was on duty did not give me the forms to fill out that day for the incident, he blew me off and told me to write it on a piece of paper and put it on his desk. Then I was in trouble for not filling out the form.) In order to get the CT scans of it done, I went to the location they told me to go (my employer after the initial visit to the clinic). Since then, I have been dealing with my former employer’s accounting department as well as the Worker’s Compensation to get this bill paid. This company will not stop harassing me for payment, even though it is not my responsibility to pay. It has been frozen several times, and I have been in contact with the company asking them to bill my employer’s insurance. They will not. I have been fighting this since last year, and just when I think it has been taken care of, I receive emails requiring payment.

I’m a single mother of twin toddlers. Everything got screwed up because I was hurt, and it’s still affecting us. I don’t have the money to pay it myself, and I don’t even know if I’d have a chance against them in court. This has been ridiculous, and I’m not even sure who I should sue, my former employer or this CT company.

I would appreciate any advice I can be given, thank you so much in advance.

Scammed by hair salon??

Was I overcharged/scammed by hairdresser?

Went to the hairdresser for half head highlights.

The price advertised online was 80 euro. However due to language barrier I didn’t ask for a price quote up front (my fault).

In the end I was charged 170 and asked to go ATM and pay cash.

On return I got my bf who speaks French to ask the hairdresser to explain the price.

She said she was charging for:

  • half head highlights (€80 euro per advertisement)
  • toner/coulage (€25)
  • Blow dry/brushing (doesn’t say price but it’s €25 for wash, mousse and blow dry)
  • olaplex treatment (€25)

That equals - €155

Not to mention I never asked for the treatment or toner.

I tried to negotiate with her. She wouldn’t give me a price breakdown or receipt. I ended up paying full 170 cash.

Fight at School

My son got into a fight at school. A teacher intervened and received a small laceration (a scratch) on her arm and a shove. The teacher is now filing a civil suit against my child (for battery), and myself as his guardian. There is surveillance of the incident, but the school claims it's too blurry to make out any fine details. They did come to the conclusion that the shove and scratch were not intentional, and merely a byproduct of the physical altercation between the two boys.

No criminal charges are being filed, just a civil suit. And I'm sorta worried about damages. We are a low income household, having said that, most people are nowadays, but I'm nervous about another financial burden. The school has admitted that they are aware of the fact that my son is bullied at school. I was wondering if, hypothetically, that may be a liability I can pursue to have the state/school compensate this woman for her claim. The teacher in question did not come to any grievous harm, or anything, and while I am aware this is most likely an attempt to snag some easy cash, it's something that keeps me awake.

A lawyer is already going to set us back a small sum, but I was wondering if anyone here might be able to calm my nerves with any insight. At the very least, thanks for letting me vent.

Auto Lender Requesting SSN After 1+ Year into Loan?

Hello, r/legal! As described, I received a text message from my auto lender asking that I give them a call to provide my SSN and DOB, as they'd never received it from the dealership. However, I signed the loan on 01/25/2023 and have been paying on said loan since. Is this something I'm legally required to present at this point, as they already approved me back in January of last year? I appreciate any insight!

Hello my family member died and left me his car. He signed the title before death but left the buyer info empty. Do I have to transfer the car to me first? Or can I sell it since he signed the title already? I’m in Florida if that changes anything.

Heavy police activity and city officials are not saying why.

We have been experiencing a lot of unusual police activity in my city and no one seems to know why. Is there a way I can get information on what's going on. We are neighbors to a big metropolis and this city is seeing a lot of crime. We are getting some trickle over and for most of the citizens that live on the city limit witness it from both sides but one covers it up and the other doesn't. We are seeing swat teams surround houses and whole blocks of neighborhoods shut down but not a word from city officials or city police. I know they are trying to keep it hush but this is getting out of hand.

Contract and Price Increases

We own a small business. We sell services for a monthly price. That monthly price is not set in the service contract, but is sent in the form of a "$0 invoice" that outlines the rate. The contract says to refer to that invoice for the rate.

If our contract does not have any language or clauses addressing a price increase on services, does that give me the legal authority to increase prices?

Also, if our contract is for service but does not outline what we will or will not cover, does that mean we can deny service for any reason we see fit?

Suing my neighbors

Hi. So I unfortunately have to taken legal action against my neighbors. Long story short, they have a bamboo plant that has completely taken over my property. And it has destroyed my sewer line and is now growing through my concrete foundation and deck. I’ve spoke to two different attorneys. It sounds like it falls under trespassing. Or nuisance. But where in out now is how to choose the attorney. One place is a big law firm and it depending in the platform the reviews don’t look great. I did think the lawyer brought up a lot of good points, such as asking if the previous owner was aware of the bamboo and damage. And also that small claims isn’t the route to go because then you will be always capped out at 10 grand. If I understood that right. But he also seemed like a salesman and it sounds like it’s a bunch of other new young attorneys that actually deal with the case. And when needing him, then you are double charged. Seems like a lot of the bigger firms are like this. I also talked to a local attorney who was much more reasonable but he didn’t really bring up a lot of the points the other guy did. How do you guys go about choosing the right attorney? This would fall under real estate law which narrows it down some.

Mom is threatening to emancipate me and kick me out

Yesterday my mother and I got into an argument and she threatened to kick me out. I am 16 years old and know there are plenty of things I have to look into. My question is can she emancipate me without my consent, and if so where should I start when looking into help. I have a friend I could stay with who already knows my situation but then there my phone plan which she pays for, my health insurance, my plans for college which she said she would help me with, and a whole bunch of other things.
