Guest committed suicide in house

I've been diving into the tenancy act this potential situation has me confused. A guest commits suicide in a house does the landlord have to disclose it and does disclose as a good faith gesture violate privacy laws of some kind.

can tenants refuse to let property management agent show the place when they are going to move out the following month?

My friend is interested in a place but she couldn't get the PM to show. PM said current tenants are making it challenging to show. My friend is just worried that she'd miss out on an opp to rent this place. Anyone has similar experiences?

Tenant complaining of mice, hired pest control and they used poisoned bait

Tenant was complaining of mice so I hired a licensed pest control company to take care of it. Got the report from the company saying they used poisoned baits, Fastrac and Flatline. According to Google they can be toxic to dogs.

If the tenant's dog and cat get sick from eating the bait or poisoned mice, am I as the landlord liable?

Coop housing and no parking. Why?

Why is it that new cooperative housing in BC, like Kinship and Sawmill, lacks enough parking and storage? It feels like low-income families are forced to compromise on basic needs. Why can’t we have practical amenities without so much frustration?

Seems quite fragmented as difficult to find a central source. Please share if you know of any. Looking for a dog frjendly apartment to rent and coming from another province. Thanks in advance.

Landlord reference, having issues.

I moved into my current place a little more than a year ago, I’ve been having issues with my building manager since day 1. He’s been inappropriate, such as demanding I spend time with him, and always making sexual comments. Anyway, I usually brushed it over so I could maintain a good relationship in order to have a reference if I ever moved out. I live in my place with my partner, he approved of him initially then of course continually threatening to kick him out. All this to say that they both do not have a good relationship which is making our housing search stressful as he says he will not put in a good word for my partner. I am not sure what to do in this case, should I go look at places solely and then have my partner move in? This doesn’t seem like the best idea either. Thank you

Landlord making me pay for professional cleaning when not in contract

I've given my one month notice and my landlord wants to take money for professional cleaning out of my security deposit saying that the unit was professionally cleaned when I moved in. This is a fully furnished condo so professional cleaning would be even more expensive than usual. My understanding of the RTA is that the unit only has to be left "reasonably clean" as per these guidelines.

There is an addendum to the lease I signed which states that "At the end of the Tenancy Agreement after the Final Inspection of the unit by the Landlords the Damage Deposit will be returned in full or partially depending on the amount needed to be paid for the repair of the damages and clean the apartment." This still doesn't mention professional cleaning so I think that I am in the right here?

My landlord also never filled in a condition inspection form upon moving in which I believe means that they cannot take money out of the security deposit for damages. My understanding that claiming the deposit for cleaning is separate from claiming it for damages however.

could not arrange Strata move in, is it still possble for small items?

I live in Vancouver, BC, and I’m about to move into a newly built condo (completed just a few months ago). Due to some miscommunication with the strata and my realtor, I haven’t arranged the move-in with the strata yet.

my contract starts tomorrow (Dec 1st). Would it be okay to move a few pieces of furniture (brand new and still in boxes) into my unit?

How can I keep my apartment?

I am living in an apartment this is perfect for me in terms of location, rent, space etc. My current agreement is about to become month to month. I may have to temporarily move to another city for about a year. Is there any way I can come back to this apartment? I recall the lease I signed said no sublets (though it is clear people are doing it in this building). My apartment building is owned by a rental company.

Does anyone have information on this place? It looks nice and the rents reasonable at $2500/month but they're doing a black Friday deal where you get the first month's rent free which seems suspicious to me. Managed by Metcap. Also concerned since it's near the bridge that it may be loud.

I just gave birth a few months ago and I had my mom and dad come stay with us for 7 weeks. My landlord is making me pay $740 for those weeks on top of our monthly rent of $1800 (includes utilities).

She said it’s for their accommodation and used of the place.

What should I do?

Landlord is MIA, we are moving

Hello,

My landlord is MIA and not responding to anything. Landlord is quite wealthy and buys/sells/develops land here. Great guy. Very wealthy. He bought this place last year and insisted on no lease agreement and cash only. It's 3200/month. Totally fine with me. He collects rent late every month. No problem. I'm very laid back as is he. There is 0 animosity here.

He hasn't responded to my texts since October 20th. I paid to fix my boiler and then let him know the cost and asked when he wanted rent. No reply. Have regularly asked.

Now there is a for sale sign out front. No reply. House listed for 6.9mil.

We move out in 2 days. Not interested in keeping damage deposit.

If he randomly calls next month I don't plan on paying. Black mold in master bath (you wouldn't believe how bad) stove is broken, toilet in master doesn't work, house is a 1957 hand build.

We already put a deposit on the next place in langley, a 5 acre lot. If he calls I could pay but meh, I don't like him not responding and leaving the upkeep to me. Plus a random for sale sign is wild.

I'm decently smart (maybe) and don't believe any legal ramifications can come as I'm not in any formal agreement to pay rent here and have given notice. Not my problem if I become unreachable.

Any input?

notice of dispute resolution from landlord after serving 4 month notice

Our landlord served us a four-month notice to end tenancy for landlord use of the property. Now, 3 weeks later, she has served us with a Notice of Dispute Resolution proceeding.

The Claims on the dispute resolution proceeding.

Claim 1:
"I issued a 4-month notice to end tenancy for landlord’s use of property and I want an order of possession."
Dispute Description:
"I am not sure the tenant will be moving out of the suite."
Supporting evidence:
No evidence submitted.

Claim 2:
"I want to include a request for the tenant to pay me back for the cost of the filing fee ($100)."

I’m planning to call the tenancy branch tomorrow because I’m unsure what evidence we need to submit. We intend to move out before the specified date and have always planned to do so.

Backstory:

Since we moved in 9 months ago, we’ve had some issues with our landlord, who lives above us. We are her very first tenants. Early on, she would show up multiply times a day letting herself in. Spmetimes just to chat other times to get things from her storage in our unit. We set boundaries, but tried to be understanding since she’s an elderly, lonely woman.

After a few months, my mom visited and signed into our shared Wi-Fi (as per the lease). When she got blocked later, I asked the landlord to unblock her so my mom could book a ferry ticket. The landlord refused, saying she wouldn’t share Wi-Fi with a "stranger." Things escalated when she accused us of purchasing a movie with her wifi account (which we didn’t do). She then told us we were liars and decieved her when we said we were a nice family on out rental application.

There have been other minor issues since, and we’re starting to think she might be experiencing early signs of Alzheimer’s due to her erratic behavior. She’s occasionally paranoid and has moments where she ignores us or the kids, only to be friendly later. Despite all of this, we’ve continued to be patient and accommodating.

Main Question:

We plan to leave as requested, but can anyone advise on how to handle the dispute resolution process? What evidence do we need to submit, and how do we proceed when the landlord hasn’t provided any actual proof for her claims?

New Rental "Trick" To Watch Out For Regarding Pets

I was talking to the realtor who was listing the place we currently rent, and he told me about a new "trick" landlords/leasing agents are using.

It now can be quite difficult to evict a tenant for violating a "No pets" clause without extraordinary damage, as many arbitrators don't consider it a "material breach" unless the entire strata building bans pets, or there are other issues with the pet.

So what leasing agents are doing is advertising their units as Pet Friendly so that people with pets will be honest about it, then simply decline their application. This is supposedly to counteract tenants wanting to "sneak" their pets in after signing a lease.

Just thought it might help knowing about this.

Increasing rent for having a pet in the unit

Hey guys,

I'm looking at a new lease for Feb and have started looking around at what's available now, to get a sense for what's in the market. One person has written on their notice:

"Max 1 Adult Pet allowed under 25lbs with a $150 increase in posted rent"

As I read on (https://www2.gov.bc.ca/gov/content/housing-tenancy/residential-tenancies/starting-a-tenancy/deposits-fees#)

"Landlords can't charge a fee for pets beyond a pet damage deposit, such as a monthly pet fee."

I called up this person I told them that I think the rent increase is illegal and they said,

"it is ok because it is not a fee, just an increase of the posted rent"

This smells all kind of bad to me, I feel like their answer is a cop out and just a way to get around the wording of the RTB "monthly fee". Has anybody experience with this? Any further answer or information for my query? All of the landlords and realtors I have dealt with in this city (and every other place I have lived) have been cut from similar cloth (lie and pressure to extract from the renter) so I am looking for something concrete so I can dispute this with them.

Can my roommate kick me out?

I currently live in a 2 bedroom apartment with a roommate. Moved in May 2023. He had already been living here before me, however his previous roommate had decided to leave so he was looking for a replacement. He put up the ad on Facebook and I managed to get the position. It was initially a one year lease, but now we are on a month to month.

Recently he mentioned that he would be looking for me to leave in a few months as he wants his GF to move in with him and take my place. Is he able to force me to leave?

We signed a new tenancy agreement when I moved in with both of our names listed as tenants from a management company. From my understanding, since both of our names are on the agreement/lease, I have a right to be there and am protected under the Residential Tenancy Act.

However I am worried that since he had the place before me, he is somehow able to kick me out. Or that there is some other loophole that I am unaware of. Please help!

Move-Out Notice Question

Hi,

I was wondering if I could ask a question about 30 day move out notice.

If I pay my rent every 15th of the month (and latest rent was Nov 15 and the next rent will be Dec 15) and I give the notice to the landlord on Nov 30 that I’m moving out on Dec 31st, am I responsible for Dec 15 - Dec 31 only? or would I be still responsible for the full month? (Dec 15-Jan 14)

Landlords vs. Tenants

I’ve been on both ends. I’ve been a landlord (parents home) and during that time I’ve done everything by the book and been a gracious and kind landlord to the only have my tenant take advantage and have to through RTB to get rid of em. It was such a headache and hassle, but recently I’ve become a tenant and I appreciate the some of the safeguards in place. I feel though that rules are there mostly to punish landlords good or bad and support tenants good or bad. I feel they should be balanced more checks in place if there’s going to be rules and committee (RTB). Just wanted to get other opinions?

Addendum contradicts lease?

Hey everyone. I'm a bit confused as my landlord has been charging my roommates and I 1/3 of utilities (we live in a semi-basement in their house) as is stated on the addendum, but looking at the actual lease, the boxes for wifi, gas, water, electricity and heat are checked off as being part of the rent we pay. They recently started to make us pay internet out of the blue even though we weren't paying for it for the first few months.

I can't find anything on the RTB website that would apply in this situation so I'm a bit lost. Anyone know what utilities are included or not in this case?

Edit: Thank you everyone who replied. No I'm not trying to weasel out of paying utilities, just trying to understand the differences between lease and addendum (my landlord is a bit new to this and she may have made mistakes). We're in no way trying to get out of paying utilities, but the internet suddenly being added certainly took us by surprise. Anyways, I think we have enough info to go off of and we'll call the RTB if ever we have more questions. Edit2: realized I miswrote last night at midnight while writing this oops.

My landlord went to my previous employer to ask and express “Concern” about me. Wtf.

I moved into a suite in august, and quit my previous job Oct1st. Started new employment October 5th.

My landlord went to my previous employer and questioned them about me, why I wasnt working there anymore, and said she was “Worried” and “concerned” about me that i was going down a self destructive path. My entire ex workplace (over 200 employees) is now gossiping probably making up their own stories about what is “happening” to me.

My landlord thought i wasn’t being transparent or truthful about me quitting and suspecting i was “fired”. I quit.

We had a major conversation about this and she thinks she has done nothing wrong, the conversation was absolutely fucked, and incredibly narcissistic on her end.

What she did was absolutely not okay in any way shape of form. I have never been late on rent and i help out with stuff on the property too.

I dont even know what to think, im in shock. Is there not some kind of section in a landlord tenant agreement or RTB about this kind of stuff? What.the.fuck.

Edit: I am having some problems with this landlord, but i have a full suite with internet for 880 a month, on the beach. I REALLY dont wanna let this go.

Edit: I was never asked to and never provided a reference for this employer.

Edit: I worked for a provincial government employer. Which i am now finding out that a management level employee had told my LL that i was fired, when i indeed resigned and have emails to prove it.

Edit: I had a very tense conversation with my landlord over the phone. She sees she has done nothing wrong, and did it to satisfy her curiosity because she thought it was being dishonest with her about my job and thinks i was “Fired” (acting like a psycho girlfriend).She did all this at the expense of my reputation, she admits this. She said a lot of super, super concerning things. My whole life i have “Laid low” in these types of situations and hoped they would blow over, and it hasn’t worked well. I hate confrontation but i will be talking with the RTB and a lawyer about this. Just for information. She needs to understand what she did was so, so wrong. Im taking a bit of a stand for once. I appreciate all of the informative responses so far.

We just got the lease agreement from our landlords management company, and I saw a line item stating the number of tenants can not exceed 2 even if our family increases "naturally" is this legal?

Roommate

Ok, trying this again...I posted about a roommate that I want to evict. My husband and I are on the lease, 18 years. My husband passed away in June. I'm now stuck with a delusional, paranoid drug addict. I did try to evict him...the wrong way in a sense. Gave him notice, he filed with the RTB, neither of us showed up. Speaking for myself, having just lost my husband I went a little off the deep end emotionally. Tried changing the locks, wrong move, cops almost arrested my stepson

So I found out from the Law School that because I'm the only one on the lease and he is not I have control. Also found another site said basically the same thing, that the RTB doesn't deal with these issues, that he'll have to take me to small claims court. I've told the roommate all of this (except the small claims stuff), sent him links, told him his rent is going up (he claims I can't kick him out or raise the rent)

Oh, it's a bedroom with bathroom, small sitting area, my laundry room, no kitchen access. He claims he only has to pay $800 as per my husband. I've asked him for rent receipts, any written agreements, no response. Not that it matters but I'm on social assistance and am paying $1000 a month to cover rent. That leaves me $60 for food and bills. Ain't happening

Just for kicks: I finally got the balls Nov 8th ish and asked him to move his car out of MY spot (where my husband parked for 18 years)...he did. 2 days later I wake up to 3 text messages from him. "Why do I have a flat tire? Now I know why you asked me to move my car. You did something to it it won't start. You're going to pay for this!". I took the last message as a threat because in March, screaming and kicking literally thru a locked door, he said "I'm going to kill her" after calling me a nasty name. Why? He called my sick and dying husband in the hospital and said I threw away/sent back the check for the sale of his house. 2 says later (recorded) he was telling his buddy the money has been in his account for awhile

Back to Nov 10, so after all that he called his Dr, told her I did something to his car, flattened his tire, and with it being a holiday and can't get his car fixed can he get his prescription early (opioid) then called his buddy and threw in some extra info: 2 flat tires, a smashed window and glued his air valve caps on, says the car was locked, doesn't know how I got in the car. 3rd phone call "remember the last time you had my car and it started up right away? Well, I'm having that problem again". No mention of any damage. Nov 11 called someone to jump his car and he moved it back into my spot.

So I started moving broken metal stuff into my spot, I can only do it when he leaves the house 11:30pm 2 nights a week. Yes, I'm getting someone to pick up the metal stuff once I get what I can out there (informed roommate of this). Came out this afternoon all my pile has been moved all the way up to my husband's truck. So much for the guy's claim he's a cripple

There's more...of course but hopefully you get the gist

So at first I'm thinking of making a "agreement" that I know he won't l Iike: no drugs of any kind, has to maintain grass in his area, police record check etc, etc, etc

But mostly boils down to being afraid of not being able to find a decent, normal roommate

And ya, I'm concerned about my physical safety. Cops said they won't do anything about the threat unless the idiot says it to MY FACE

And, right or wrong, I DID call his Dr and told her his story was bs, that he lied to scam his prescription early, that that's his business but I don't appreciate being accused of doing something I didn't do just so he could get his "fix". No, I did not tell her about the 3 (for sure) or 4 people he buys methadone off of and the percocets and all his lies about his "back injury" (3 different stories so far)

So, question is: why am I even contemplating this? I'm not. What I'm worried about is not being able to find someone to rent the space out to. For context: non-working farm, South Surrey, space isn't perfect but it's OK. The plan was for me to move into that area and my stepson and his family take over my whole area but...18 years of collecting, smoking house, walls and carpets need to be cleaned yada yada yada

Anyhow, I am very tense right now, feeling like I don't have a leg to stand on and I truly don't have anyone I can turn to ask for advice/help or someone who's a pit bull to help me stand up and be brave, stand my ground

I know there are good realtors out there. How do I find them?

Looking for a buyer's agent in Vancouver BC. I know the market well enough, how to search comps, how to read strata documents, how to book showings, but don't care about any market/interest rate predictions. To me a good buyer's agent can find a good deal that meets our needs, has extensive knowledge about the area, future development, zoning, pitfalls, property/strata specific issues, response promptly during office hours and crucial moments, reasonable customer service.

But the whole compensation structure is really misaligned. Most/all agents are paid at the transaction, why would they want to negotiate with my interest at heart when it could lose them the deal? Why would they put in the subject for me that could jeopardize the deal? I suppose there is the code of ethics (haha). There is also the reputation thing, maybe someone near during their peak career earnings would care a lot about protecting their reputation.

Why does a new realtor and a 20 year experienced one that is the top 0.1% producer get paid the same when they close the deal? I don't mind a new realtor if the fee they take is substantially lower as they are mostly just the transaction coordinator.

DIY could be an option but it is easy to miss some crucial factors. Most DIYers don't even know they made a mistake after they bought a place and I am self-aware enough to know that.

So far I have these interview questions in mind

  1. Which area/property type/price range is your expertise? (no I didn’t tell you what I am looking for yet, and you will be the one if you said a very niche answer and it matches my target exactly)

  2. how many deals have you closed in the last 3 years? Your deal or part of a team?

  3. how would you address the compensation misalignment?

Any thoughts? Any realtors want to try to answer my 3 questions?

Tenants damage and safety deposit?

Hi there! Sorry for the long text !

Before I even tell the story, just wanted to say that I am not a big company or slumlord, just a gal that saved up all her introvert boring life to buy a small place in Coquitlam and rent it out. Not making profit, not using the tenants to pay my mortgage. I am just doing my best, trying to offer housing options to good people.

These are my 5th tenants and I only had wonderful experiences. My last tenants left early (after 5 months, breaking their year lease because they bought a place). We had a move-in and move out inspection : Turns out they created a lot of damage my kitchen floor because their dog water bowl was directly on the wood, and the water damaged/curled up all the wood. Plus a bunch of scratches, but I consider that wear and tare.

During the walk-out inspection, we noted the before and after condition, and agreed that I should keep the safety deposit (verbally...) to repair the floors. The floor will cost 6,5k to repair, the safety deposit is 2,5k. All good with me, I was happy they were able to find a new house for their growing family.

So they moved out, we shook hands, bought them a champagne bottle to congratulate them on their house purchase.

Now I got a message from the RTB asking for their deposit back, 2 months later. I don't have anything in writing, so not sure how to refuse. What should I do?
